General Terms and Conditions Vinofreddo - Draft 2026

These general conditions apply to all offers, orders, agreements and deliveries of Vinofreddo.


Article 1 - Definitions.

Vinofreddo: the company that offers and sells wine coolers and related products.
Buyer: any natural or legal person who enters into a contract with Vinofreddo.
Product: all wine coolers, accessories, parts and services offered by Vinofreddo.
Agreement: any agreement between Vinofreddo and buyer regarding delivery of products or services.

Article 2 - Applicability.

These general terms and conditions apply to all offers, orders and agreements of Vinofreddo.
Deviations from these terms and conditions are valid only if agreed in writing.
Any terms and conditions of the buyer are expressly excluded unless otherwise agreed in writing.


Article 3 - Offer and agreement

All offers and quotations from Vinofreddo are without obligation.
Obvious errors or mistakes in prices, images or product information do not bind Vinofreddo.
A contract is established as soon as Vinofreddo confirms an order.
Vinofreddo reserves the right to refuse orders or impose additional conditions.


Article 4 - Product Information

Vinofreddo strives to display products as accurately as possible.
Images, colors, dimensions and specifications may vary slightly from the delivered product.
Minor deviations do not entitle you to rescission or compensation.


Article 5 - Prices

All prices on the website include VAT unless otherwise stated.
Any shipping costs will be clearly stated before completion of the order.
Vinofreddo reserves the right to change prices.
Price changes after ordering do not affect orders already confirmed.


Article 6 - Payment

Payment must be made via the payment methods offered.
Vinofreddo may suspend delivery until full payment is received.
If payment is not made, Vinofreddo is entitled to charge statutory interest and collection costs.


Article 7 - Delivery

Vinofreddo strives to deliver orders within the specified time frame.
Delivery dates are indicative and do not constitute a deadline.
Delay in delivery does not give an automatic right to compensation.
Delivery will be made to the address provided by the buyer.
Risk of damage or loss passes to buyer once the product is delivered.


Article 8 - Transportation and receipt

Buyer must check the product for visible damage immediately upon receipt.
Any shipping damage must be reported within 48 hours of delivery.
If damages are not reported in a timely manner, Vinofreddo cannot recognize any liability.


Article 9 - Right of withdrawal and returns

Consumers have the right to revoke an online purchase within 14 days without giving a reason.
The cooling-off period starts the day after receiving the product.
Products should be returned unused, complete and if possible in original packaging.
Return costs are the responsibility of the buyer unless otherwise agreed.
Upon correct return, the purchase price will be refunded within 14 days.


Article 10 - Warranty

Vinofreddo products are subject to the applicable warranty as stated in the warranty conditions.
Warranty applies only to normal household use.
Warranty voided at:
misuse;
improper installation;
damage from external causes;
modifications or repairs by unauthorized third parties.


Article 11 - Liability

Vinofreddo shall only be liable for direct damages resulting from intent or gross negligence.
Vinofreddo is not liable for:
indirect damage;
consequential damages;
lost profits;
damage due to misuse;
damage caused by improper installation.
Vinofreddo's liability is limited to the amount of the order to which the liability relates.


Article 12 - Retention of title.

All products delivered remain the property of Vinofreddo until full payment has been made.
Until payment is made in full, buyer may not pledge or resell the product.


Article 13 - Force majeure

Vinofreddo is not liable for delay or non-performance due to force majeure.
Force majeure means any situation beyond the reasonable control of Vinofreddo.
These include:
transportation problems;
strikes;
power failures;
pandemics;
government measures;
supplier supply problems.

Article 14 - Complaints

Complaints about products or services should be reported within a reasonable time.
Complaints can be made through the contact form or by e-mail.
Vinofreddo strives to answer complaints within 14 days.


Article 15 - Privacy

Vinofreddo processes personal data in accordance with the privacy and cookie statement.
This statement is available on the website.


Article 16 - Applicable law

All agreements are governed by Dutch law.

Disputes shall be submitted to the competent court in the Netherlands.
